I. SUBJECT AND PROCESSING OF PERSONAL DATA
1. Applicable regulations
Any person accessing the website https://beneteau-boat-club.com/ (the “Website”) shall be considered as a “User”. Users are hereby notified, and accept, that their personal data will be collected from the Website and processed by the company SPBI, which legal information appears on the Website (the “Company”) acting in its capacity as Data Controller, according to the terms of Regulation (EU) No 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (the General Data Protection Regulation - “GDPR”).
2. Processing of personal data
Mandatory personal data are those personal data that are strictly necessary for the processing of Users' requests. In the absence of such data, the User is informed that certain services offered by the Company cannot be provided. The compulsory nature of the information requested is indicated by an asterisk at the time of collection. The optional personal data collected by the Company are intended to get to know the Users better and to improve their browsing experience on the Website.
The User's personal data is processed only with his consent.
How personal data is collected: when the User fills in the online contact form; when the User subscribes to the newsletter; when the User selects a Boat Club package and chooses to be contacted by the selected Boat Club base.
Legal basis for the collection and processing of personal data: specific, free and informed consent of the User; fulfilment of a legal obligation incumbent on the Company; fulfilment of a contract concluded between the Company and the User (in particular for the fulfilment of the general conditions of use and/or sale).
Purposes of the processing of personal data:
- Creation of the User's member area and access;
- Subscription to the Company's newsletter;
- Contact and assistance by the Company;
- Management of the commercial relationship and connection with a Boat Club;
- Commercial prospecting;
- Sending goodies (advertising products);
- Carrying out operations relating to the management of services (contracts, invoices, orders, etc.);
- Organisation and management of competitions.
Users are informed that, subject to their prior, specific and positive consent, the personal data transmitted may be transferred to the Company's service providers and/or commercial partners so that they can inform Users about their offers and services.
Access to personal data:
Duration of storage of personal data: the User's personal data is stored for a period of three (3) years from the date on which the User communicates it to the Company.
3. Exercising of rights relating to personal data
In accordance with the GDPR, User benefit from:

Each request to exercise Information Data Protection Rights shall be signed and accompanied by the photocopy of an identity document bearing the User’s signature and specifying the address to which the Company should reply. The reply to the request exercised on the basis of one or more Data Protection Rights will be addressed within a maximum time limit of two (2) months starting from the receipt of the request by the Company.
The User also benefits from a right of appeal to a national regulatory authority such as the French National Commission for Data Protection Rights in the event of any breach of the regulations applicable in terms of the protection of personal data, and specifically the GDPR.
Users may, moreover, unsubscribe at any time from newsletters or any other communication sent by the Company by clicking on the unsubscribe link included in each newsletter, etc.
II. COOKIES
